بالنسبة للمرأة التي غاب عنها زوجها أثناء الحرب وكان قد استشهد من أول الحرب، وهي لم تعلم بذلك إلا الآن؛ هل تبدأ العدة بعدما عرفت بوفاته، أم تكون العدة قد انتهت، وقد مضى على الحرب ستة أشهر؟ الجواب/ الحمد لله، والصلاة والسلام على رسول الله، وعلى آله، وصحبه، ومن والاه، أما بعد: إن المرأة المغيب عنها زوجها وعلمت بوفاته أو استشهاده أو طلاقه بعد زمنٍ؛ فإن عدتها تبدأ من حين الوفاة أو وقوع الطلاق، لا من حين بلوغها الخبر، وعلى ذلك جماهير أهل العلم. وعلى ضوء هذا؛ فأيما امرأة غاب عنها زوجها من أول نازلة الحرب وما علمت بوفاته إلا بعد مدة تزيد على عدة الحائل -غير الحامل- المتوفى عنها زوجها.. أربعة أشهرٍ وعشرة أيام؛ تكون قد انقضت عدتها، وصارت حلالاً للأزواج. وإن كانت حاملاً؛ فهي في عدتها من وفاة زوجها حتى تضع حملها؛ لقوله تعالى: ﴿وَأُولَاتُ الْأَحْمَالِ أَجَلُهُنَّ أَنْ يَضَعْنَ حَمْلَهُنَّ﴾ [الطلاق: 4]، والله أعلم. 🖋 أ.د. سلمان نصر الدايه
